The EFF recently filed a similar brief in the Second Circuit - both cases were victories for Flo & Eddie, aka The Turtles (pictured right) who successfully persuaded district courts that state copyright law restricts public performances of pre-1972 sound recordings in their battle against SirusXM. Court of Appeals in case betwewen sixties pop stars the Turtles (Flo & Eddie - Howard Kaylan and Mark Volman) and SiusXM, contesting the lower court's assertion in dicta that the performance rights being established under common law might apply to broadcast radio as well and arguing that New York state law does not support a common law performance right in sound recordings and saying that upholding such rights would be "impractical and destructive.
