Attorney Kevin Danielson of Tulsa argued the context of the law shows it applies only to proceedings in federal court, not state clemency hearings.He cited a 1994 decision by the appellate judges that said "federal courts should not be required as a routine matter to fulfill the state's obligation to provide an adequate and effective" appeal for indigent criminal defendants. Intervening in the ongoing pay dispute in Massachusetts' bar advocates program, Supreme Judicial Court Justice Francis Spina has ordered judges to appoint lawyers for indigent defendants, with or without the lawyers' consent, and ordered judges to report any attorneys who refuse to take a case without a valid excuse to the state Board of Bar Overseers.
