While we agree with the sentiment about tort law - strip away the constitutional overlay and the court gave a pretty good description of conflict preemption - the notion of FDA approval as expressing "collective" medical and scientific judgment is questionable when a very large percentage of all prescriptions written in this country are for off-label uses.
