As explained in Hesham Ali v Secretary of State for the Home Department [2016] 1 WLR 4799, Parliamentary and public concern about failures to deport large numbers of foreign citizens who had committed serious offences in the UK led to the adoption of the UK Borders Act 2007, which provided that for the purpose of the Secretary of State’s power to deport under the 1971 Act, the deportation of a foreign criminal is conducive to the public good.
