Patry believes that 17 USC 113(c) should have protected S&L here, but as Rebecca explains very well, 113(c) may not be germane--Designer Skin admitted that S&L could recreate its own shots if it wants to (see FN9 of the opinion), so the only question is whether the photos actually displayed on S&L's site were independently created.   (Civil rights acts authorize reasonable hourly attorneys fees for prevailing parties, to be paid by the losing parties, and so attorneys on that side of the game normally won't become involved in an action unless they assess the chances of being compensated, either from a settlement or a fee award, as reasonably good, although they might make an exception for a case they find interesting although a long-shot. I am not an expert in criminal law ethics, but based upon usual principles (it's almost impossible for a single lawyer to represent multiple defendants in a criminal action and conflicts are imputed), it would seem like the PD office would be disqualified. [read post]
