 In fact, in one recent case that has been sent back on 2 occasions for rehearing (once by the Appeals Council and once by Federal District Court), the ALJ’s decision was vacated and the case was remanded for further hearing for failing to acknowledge the testimony of his own medical expert, called to testify in person at hearing, that the claimant would have difficulty maintaining regular attendance as a result of her mental health problems.
