  I would have thought as an original matter that a federal constitutional challenge would be a better way to attack this state constitutional amendment, but that is only in theory, of course, because one must face the reality that the federal courts are conservatively constituted as a result of the fact that Democratic presidents have had the opportunity to appoint only two justices of the US Supreme Court since 1969, when Richard Nixon was elected president.
