The Court stated that although the Promise Doctrine is viewed as uniquely Canadian, it has its roots in English law in Hatmaker v Joseph ((1919) 36 PRC 231) and Re Alsop's Patent ((1907) 24 RPC 733 - "false suggestion or representation") where, the now extinct doctrine the Court referred to as the "False Promise Doctrine" derived. This basis of jurisdiction had been recently applied by the English Court of Appeal in Cartier International AG & Ors v British Sky Broadcasting Ltd & Ors [2016] EWCA Civ 658 (06 July 2016) in affirming the jurisdiction of English courts to make blocking orders against Internet Service Providers requiring them to disable access to foreign websites that offered counterfeit goods for sale.
