In a letter dated June 11, EEOC Assistant Legal Counsel Christopher Kuczynski responded to a public inquiry objecting to the EEOC’s assertion in an earlier informal discussion letter that a high school diploma requirement may violate the ADA if it screens out, or tends to screen out, a person with a disability or a class of people with disabilities, unless the employer is able to demonstrate that the requirement is job-related and consistent with business necessity.
