In Legislative Courts, Administrative Agencies, and the Northern Pipeline Decision, 1983 Duke L.J. 197, Martin Redish acknowledged the practical problems that would follow if the Supreme Court were to strike down the independent agencies as unconstitutional, nevertheless also contended that the language of the Constitution simply does not allow such agencies.
