Casey (1992), a case on which Justice Kennedy also relied in Lawrence, the Court did not speak in terms of privacy and fundamental rights using the familiar vocabulary of the earlier reproductive rights cases, although some of the high-flown rhetoric in that opinion -- derived by Justice Scalia as the "sweet mystery of life" passage -- certainly lends itself to talk about fundamental rights.
