The Court found that the Home Office had acted unlawfully in a number of ways, finding multiple breaches throughout the 3-part assessment of human rights law: that any interference with the Claimants’ Article 8 rights were (1) in accordance with the law, (2) necessary in a democratic society in pursuance of a legitimate aim, and (3) proportionate to that legitimate aim.
