According to Professor Eric Goldman, a law professor at Santa Clara University who tracks this issue, the prevalence of emojis in court cases across the country has followed a “J curve” pattern, beginning with just a few cases back in 2004 but then rising exponentially; in fact, more than 30% of all reported court cases mentioning emojis appeared in 2018 alone. Between 2004 and 2019, there was an exponential rise in emoji and emoticon references in US court opinions, with over 30 percent of all cases appearing in 2018, according to Santa Clara University law professor Eric Goldman, who has been tracking all of the references to “emoji” and “emoticon” that show up in US court opinions. [For the last, Eric Goldman will almost certainly disagree but I think that a bar could reasonably determine that attorneys shouldn’t pursue partnerships with entities that cook the books in the manner alleged.]The court dismissed the claim; the challenged practices/statements were nonactionable opinion and puffery.
