[14] I find that the current law is correctly stated in Fraser and Horn,  The Conduct of Civil Litigation in British Columbia,  Vol. 1 looseleaf (Markham:   LexisNexis Canada Inc., 2006) at paragraph 18.10: An amendment to Rule 40(27)(a) in 1992 re-affirmed the long-standing jurisprudence that the testimony of a party on discovery was not admissible against his co-party.
