Here, I wish to flag one line that rings true for Texas court watchers: While I can understand the Court's apparent desire to delay enforcement of HB20 while the appeal is pending, the preliminary injunction entered by the District Court was itself a significant intrusion on state sovereignty, and Texas should not be required to seek preclearance from the federal courts before its laws go into effect. In R v Harvey [2015] UKSC 73, the Supreme Court allowed the appeal of Mr Jack Harvey (the appellant) against the decision of the Court of Appeal (Criminal Division) and confirmed that when making a confiscation order, and assessing the amount of benefit obtained by an offender within the meaning of the Proceeds of Crime Act 2002, s 76(4), any VAT paid or accounted for to HMRC, should be ignored.
