It is known as a Third Party Costs Order, and the relevant authority is Section 51 of the Senior Courts Act 1981 and Part 46.2 of the Civil Procedure Rules.Some useful guidance can be found in the case of Dymocks Franchise Systems (NSW) Pty v Todd in 2004.Although a Third Party Costs order should only be made in exceptional circumstances, this means no more than outside the ordinary run of cases where parties pursue or defend claims for their own benefit and at their own expense.
