They file suit especially if they think you own an asset they can attach a judgment to, live in a state where they can garnish your wages (no garnishment in South Carolina), or think they can get a default judgment and chase you around for ten years, periodically dragging you in front of a judge for an examination of your bank accounts, assets, and general ability to pay - which is an enormous humiliation.
