Having campaigned against software patents in the EU, my personal view is that the European Patent Office as well as national courts act as if Art. 52 EPC didn't exist as far as entire patent claims are concerned, and while the situation is indeed substantially better with respect to what counts in a novelty or inventiveness context, the statutory exclusions have simply been gutted.
