Here, the U.S. filed a forfeiture action against currency allegedly traceable to the defendant's crimes (crimes the U.S. then indicted him for), the defendant filed a claim to these funds, the state court then indicted the defendant on 101 counts, and the defendant showed up to two pretrial conferences in state court but then skipped town three days before trial.Under those circumstances, can you strike the defendant's claim in the forfeiture action? In upholding the decision of a zoning board denying an area variance, the Appellate Division in Fowlkes v Board of Zoning Appeals of the Town of North Hempstead noted that the variance could not have been limited in time to the term of ownership of the present applicant. [read post]
