This right has been interpreted in a restrictive manner: according to People (DPP) v Buck [2002] 2 IR 268 Gardaí are permitted to interrogate the suspect before the solicitor has arrived, provided that they are making bona fide attempts to provide him with a lawyer and they are not obliged to defer a suspect’s arrest until such time as the solicitor is likely to be available.
