The Justice Department is part of the Executive Branch and were the Judiciary merely to rubber stamp all settlements entered into between the departments of the Executive Branch and private parties, turning them into judicial orders on the say so of the Executive Branch or other government agencies and departments, the separation of powers would very meaningfully cease to exist.
