A representative of independent music labels complained about the dominance of the big record labels, and suggested that there be a compulsory license for the use of sound recordings by interactive music services – seemingly as some of these services negotiate deals with big labels and offer the indies a lesser take-it-or-leave it royalty rates for those services. Either way, there is a staggering productivity cost—Google has largely automated its DMCA response process, but artists and indie labels have to send the notices one by one every time an infringing file is reposted whether it is in search results, advertising on rogue sites (probably not subject to DMCA in the first place), Blogger or YouTube. While creators and distributors have not rejected UGC (companies like Veoh and Viacom signed up to the UGC Principles), Google is still bashing it out with YouTube in court (and from what I hear has yet to pay indies) and did not sign up to the UGC Principles, having some litigation principles of their own, apparently.
