While Congress can ignore problems or refuse to wrestle with hard questions, and mostly does so or even makes things worse by acting (just ask Judge Michel), courts can’t ignore the questions that come to them about whether a certain technology is infringing by saying, well, I don’t see anything here about no shifting.
