In these two cases, the Fort Worth matter was sent back to Judge Chupp's court for a trial, and the Church of the Good Shepherd case was likewise sent back to the trial court in San Angelo for further proceedings.The action by SCOTUS now frees both of those cases to move ahead.In Fort Worth, Bishop Iker's attorneys have filed a motion for summary judgment which is scheduled for a hearing in December. A Superior Court judge in Kern County recently granted the plaintiffs' motion for summary judgment on the nonsensical grounds that it was required, under "neutral principles of law," to defer to the "ecclesiastical determinations" of the Episcopal Church (USA).The judgment would most likely be overturned by the same Court that reversed the earlier and similar summary judgment in the Fresno case, but that would mean another two to three years of litigation and thousands and… [read post]

You probably already guessed before I tell you: the trustee in question is the Episcopal Church (USA); the trust fund is ECUSA's endowment (some $366 million as of the end of 2016); the $6.8 million was loaned by ECUSA's Executive Council to the Episcopal Diocese of San Joaquin to keep it propped up during its ten-year lawsuit to "recover church properties"; and the $1 million is all that the Diocese of San Joaquin is now able to repay after… [read post]
