Judge Purdy respectfully endorsed the 'very powerful observations' of Lord Phillips, President of the Supreme Court, in Norris v USA [2010] UKSC 9, who disapproved of general considerations but accepted the exceptional circumstances in which Article 8 would lead to a discharge of an otherwise perfectly proper extradition request.
