In other words, knowledge (of the risk) that facts exist that cause copyright to subsist - someone composed the music, it may well have happened within the last 50 years or whatever, it may well have happened in the US (or any country that turns out to have a copyright law we recongise), they may well not have declared their work free for anyone who gets it, who ever did it may well not have got the nod from the owner - will suffice.
