  Whether or not Killinger et al. will ultimately prevail or will ultimately decide to settle, it seems they've reached the point where they're telling the FDIC that if its thinks it can prove a breach of duty of due care notwithstanding the prudent business judgment rule, then have at it, because the defendants aren't buying what the FDIC is selling in the way of a settlement offer.
