The Supreme Court of Ohio ruled today that when a criminal case is remanded for resentencing because a trial court failed to merge two or more criminal charges that are “allied offenses of similar import” in setting the defendant’s sentence, the court must hold a new sentencing hearing at which it addresses all of the convictions that remain after the state has selected which of the allied offenses it wishes to pursue.
