The holding of the Fifth Circuit was that the Bankruptcy statute of limitations, contained in Section 108(a) of the Bankruptcy Code (two years) preempted the one year Louisiana statute of limitations for legal malpractice.The underlying action was a multi-million dollar judgment against Gary Eugene Hale, which forced him into bankruptcy.
