In a report that predated the activation of the crime of aggression in 2017 (so that the ICC may exercise jurisdiction in relation to it), one of the rationales that the 7-22 ILC Class gave for precluding the crime of aggression from their Draft Article 7 was that the crime had not been activated for ICC’s jurisdiction, though it was always listed in the Rome Statute.
