It was only a few years since Seager v Copydex: in two seminal Court of Appeal rulings, Lord Denning established both that the hitherto equitable doctrine that a breach of confidence might be restrained was in fact an “equitable tort” and that a court might award compensatory damages just as it would for the commission of any other tort.
