The Ninth Circuit conceded that Windsor (the recent Supreme Court case) doesn’t directly contradict Witt (the older Ninth Circuit ruling), but determined instead that the reasoning of Windsor is in tension with Witt—that the two cases seem to reflect different mindsets—so that if we had to predict how today’s Supreme Court would decide Witt, we might bet that the Court would reach a result that is different from that reached by the Ninth Circuit in Witt.
