The basis of the Principle of availability is that it is not in the public interest for one trader to register a trade mark and thus gain a monopoly over descriptive terms as this would prevent other traders from using the same words, for example if one greengrocer trademarked the word orange then other greengrocers would face infringement suits for merely naming their products / describing see for example the work of Pfeiffer .
