To an extent, this reflects the original sense approach that I discuss above, and in the essay, but it also reminds me of the approach that John McGinnis and Michael Rappaport tend to advocate, which is to read the Constitution as consisting largely (if not entirely) of legal terms with technical meanings readily apparent to those in the founding era.
