An employer who accesses any information that is password protected or otherwise not available to the public without the authorization of the potential employee will be subject to liability under the Stored Communications Act (SCA), which prohibits intentionally accessing or exceeding authorization to access a facility in which an electronic communication is provided and thereby obtaining access to an electronic communication stored in the system.
