The Court was satisfied that it met the test set by Neuberger J in National Westminster Bank v Jones [2001] 1BLC 98 before the court could reach such a conclusion it must be satisfied that the purported agreement is no more than the piece of paper which the parties have signed with no intention of it having any effect, save that of deceiving a third party and/or the court into believing that the purported agreement is genuine.
