ISL’s insistence that “legislature” refers to a particular governmental body—rather than a state’s system of making laws—simply can’t be squared with, among other things, the early (founding-era) involvement of governors in Massachusetts and New York (and judges as well in New York) in the formation of congressional-election regulations.That a majority of the Court seems to reject ISL’s basic textual premise is good news.
