  It seems that when the Constitution binds Congress, it generally does so in the active voice (“Congress shall make no law”) or, in the passive voice, it speaks in unmistakably legislative terms (“no bill of attainder or ex post facto law shall be passed”).But most of the Bill of Rights does not sound like that.
