  Discussion When I first saw a report of this case before reading the opinion, I assumed that there must have been a typo; how could a prior and pending litigation provision with a P&P lit date in May 2000 have anything to do with whether or not subsequent lawsuits related back to a prior lawsuit first filed in 2006, six years after the P&P lit date?
