Coglianese, a professor at the University of Pennsylvania Law School and director of the Penn Program on Regulation, and Starobin, a professor at Bowdoin College, point to the failure of an effort by the government of Albuquerque, New Mexico to impose more energy efficient building codes, which a court blocked after industry successfully challenged the standards as federally preempted.
