The linchpin of Mostyn J’s conclusions in his recent series of judgments is (a) that the correct interpretation of Scott v Scott [1913] AC 417 is that financial remedy proceedings which are not concerned with child maintenance are and should always have been heard in public or as if in public, and (b) that, even if this is not right, the 2009 rule change which admitted accredited journalists to hearings of financial remedy proceedings rendered them public hearings.
