We already make this kind of distinction in other contexts, for example, someone who has a valid mark can oppose registrations on 2(d) confusion grounds, but if you don’t have a mark but do have fame that you aren’t using as a mark in commerce on goods or services, you can oppose using 2(a), which bars registration of trademarks that "falsely suggest a connection with persons, living or dead” or with institutions.
