Surprisingly this nettle has only really been grasped once before, by the House of Lords seven years ago in R (Mullen) v Secretary of State for the Home Department, where the question whether the abuse of process in getting the defendant deported from Zimbabwe to trial in the UK rendered his conviction so unsafe as to qualify him for compensation for miscarriage of justice.
