  Carter’s complaint was dismissed with prejudice by the District Court pursuant to the first-to-file rule, but was brought back to life by the Fourth Circuit when it ruled that, because the earlier-filed action had been subsequently dismissed, the trial court’s dismissal should not have been with prejudice and Carter was free to re-file his case.
