  Based on an ACLU press advisory issued this morning by Matt Coles, Director of their LGBT Rights Project, which litigated the case, the court majority used the thoroughly disreputable (my description, not Matt's) and totally specious (ditto) rationale that this is a rational basis, not strict scrutiny case, and that the state could rationally decide to extend marriage only to different-sex couples because it was necessary to channel their procreative activities.   That’s right, it seems to me, if we can all agree that the degendered marriages the states afford people today are the marriages to which they have a protected constitutional right; if in degendering the marriage, the states did not violate the due process clause. [read post]
