If there is even a one percent chance of a problem with Whitaker’s appointment that might make FISA applications vulnerable to challenge, they should stick to Rod Rosenstein and/or John Demers, the deputy attorney general and acting attorney general for national security, who are unquestionably able to approve the FISAs (assuming Demers has been properly designated).
