The High Court refused the application and distinguished the decision in DS v Judges of the Cork Circuit and the DPP [2008] 4 IR 379, noting that DS was concerned with successive jury disagreements after a complete trial, whereas in this case the jury was discharged each time following the evidence of the complainant.
