The rest of Texas' COPS grants went to smaller jurisdictions, with the most officers among smaller towns going to Galveston PD and the Galveston County Sheriff, one assumes to make up for shortfalls in the wake of Hurricane Ike.Looking at the applicant rankings by state on the DOJ website, we find a list of other Texas departments that applied but I haven't seen information about how many officers each of them asked for. True, many jails are full (pdf), but as in Nacogdoches County, I believe overincarceration in Texas stems largely from decisions by elected officials, not raw demographics beyond their control.Bottom line: Texas pols can either support more jail building or they can support keeping taxes low. They should start by implementing HB 2391, the only legislation passed in 2007 by the 80th Texas Legislature aimed at reducing jail overcrowding.In both Harris and Smith counties, the Sheriffs and local PDs refused to allow their officers to use new discretion created this year by the Legislature to issue a summons instead of making an arrest for certain low-level, nonviolent offenses. Elsewhere in Texas, Nacogdoches inmates bring in $900 per day in revenue to Gregg County, but obviously costs Nacogdoches taxpayers the same amount.Meanwhile, California plans to send 8,000 prisoners out of state in the next few years despite four recent inmate deaths in out of state contract facilities - given trends in private capacity, I'll bet a lot of those wind up in Texas.It's also becoming increasing clear based on the incidents at Geo units… [read post]

On Sunday the Longview News Journal reported that the Smith County Sheriff and Tyler Police Department will not allow their officers to use new discretion to give citations instead of arrest for low-level, non-violent offenders - the only bill passed at the Texas Legislature in 2007 aimed at reducing jail overcrowding.
