Both SEC Chair Jay Clayton and Stephanie Avakian, the Co-Director of the Division of Enforcement, have made clear that they would “like to see better disclosure around [cybersecurity]” [1] and could “absolutely” bring a cybersecurity disclosure enforcement action.
