This idea, which I’ll here call “fidelity” seeks to balance the contrasting views of deference by suggesting that agencies should seek to determine the best reading of the relevant statues by using all available resources, and, if they do conduct this analysis appropriately and base their action on the best available information, courts should defer to their judgment, regardless of the “size” of the issue.
